Brazilian Registration Holder (BRH)

COMPLIANCE IN BRAZIL

Big opportunities come with complex regulations. But entering Brazil’s medical device market shouldn’t have to be complicated.

Foreign manufacturers need a legally established Brazilian Registration Holder to obtain and maintain ANVISA market authorizations. That’s where your journey into Brazil starts with MEDAGENT.

As your trusted local partner, we bridge the gap between international manufacturers and Brazilian regulatory authorities. From preparing documentation and managing ANVISA submissions to supporting ongoing compliance, we help you navigate the regulatory requirements with confidence.

What is a Brazilian Registration Holder?

The Brazilian Registration Holder is a legally established entity responsible for maintaining medical device authorizations with the Brazilian Health Regulatory Agency Agência Nacional de Vigilância Sanitária (ANVISA) and fulfilling applicable regulatory obligations throughout the product lifecycle.

Your regulatory pathway depends on the device’s intended purpose, risk classification, and applicable requirements under ANVISA RDC 751/2022. Class I and II devices generally follow the Notificação pathway, while Class III and IV devices require Registro. Depending on the product, additional requirements may include Brazilian Good Manufacturing Practices (BGMP) certification, INMETRO certification, and specific technical documentation.

The BRH also manages applicable post-market obligations, including regulatory amendments, vigilance reporting, and registration renewals where required.

Frequently Asked Questions

Can a Foreign Manufacturer apply directly to ANVISA?

No. Foreign medical device manufacturers must appoint a legally established Brazilian company to act as their local Registration Holder. This entity holds the regulatory authorisation and assumes the applicable responsibilities towards ANVISA.

Does every Medical Device follow the same registration process?

Not quite. The regulatory pathway depends on your device’s intended purpose, risk classification, and applicable ANVISA requirements. Under RDC 751/2022, Class I and II devices generally follow the Notificação pathway, while Class III and IV devices require Registro. MEDAGENT helps you identifying the appropriate procedure and documentation requirements for your product.

Do we need INMETRO or Brazilian GMP Certification?

That depends on your device. Certain medical devices require additional conformity assessments, such as INMETRO certification or Brazilian Good Manufacturing Practices (BGMP) certification, depending on their classification and applicable regulations. We help you assess these requirements early in the process, so you can plan your regulatory strategy with greater clarity and avoid unnecessary delays.

Who Owns the Brazilian Registration?

The Brazilian Registration Holder is the legal holder of the local regulatory authorisation issued by ANVISA. Because this role involves significant regulatory responsibilities, arrangements regarding commercial rights, registration transfers, and termination should be clearly defined in a written agreement. A transparent setup from the beginning helps protect your interests and supports long-term regulatory continuity.
